Reference to ‘black24’ or ‘us’ or ‘our’ or ‘we’ means black24.  Reference to the ‘website’ or ‘site’ or ‘the service’ means the website,’black24.co.za’. By using the our website, submitting or posting any content on our website, you agree to be bound by these term and conditions

• You may not use the website if you are a competitor of black24.
• You will not post any derogatory material, fake or defamatory reviews, pornographic material, obscene material, any material that violates another person’s rights as enshrined in the constitution of the Republic of South Africa

• You will not engage in any conduct that threatens, harass or harm others in any way
• You will not violate any applicable law
• You will not reverse engineer, amend copy any portion of the website’s source code
• You will not offer incentives of any kind, in exchange for the posting of reviews of your business or to remove or prevent reviews. You agree that black24 may publicly notify consumers about such incentives and other attempts.

4. Misuse of website 

Please reports website problems, any misuse of the website or any ads that contravene these terms or applicable law to black24. black24 does not check the veracity of information or content on the website. black24 does not vet users when they register an account on the website. The onus is on you to verify listings, posts, adverts, users or any information on the website. You are warned that not all users of the website have good intentions. Here are some of the tips to bear in mind:

• If it’s too good to be true, it’s probably a scam – be wise!
• You need to be vigilant at all times and must be wary of evidently unrealistic listings, adverts and offers
• Verify the seller/service provider prior to making any payment. Scammers insist on payment first – be vigilant!
• You should verify the authenticity of the listing/advert before visiting the site of committing to a transaction.
• Should you require to meet the seller, do so not alone, under very safe conditions in safe public spaces
• Inform your next of kin or friends prior to meeting seller
• Insist on seeing the items for sale before making a payment
• Do not accept a proposal to have items mailed to you only after you have made the payment.

5. Dealing with other users

black24 simply provides a platform for users to list their businesses and trade. We are not involved in any transactions, interactions or dealings between you and other users of the website.  Dealings, transactions, interactions are solely between you and other users. You agree that black24 shall not be liable for your transactions or interactions or dealings with any other users found on the website or through the website. This includes, but is not limited to appointments, reviews, visits, chats, conversations, delivery of goods and services, payments and any other terms, conditions, warranties or representations in relation to such dealings. You agree that black24 is under no obligation to get involved in disputes between users of the website. In the event any dispute arising, you agree to release black24 and its officials from any claims, damages, proceedings of any kind arising from the disputes as well any responsibility to get involved in such disputes.

6. Accounts 

No other person is permitted to use your account. You must keep your account login credentials secret. You must notify black24 of any misuse of your account. You may not access or use black24 using another person’s account.

7. Cancellation and suspension of account

black24 may cancel, suspend or remove your account is if it is in violation of these terms. black24 reserves the right to take further legal steps in its discretion.

8. Advertisements 

Advertisement/listings not in violation of these terms are welcome. The length of time your advert/listing stays visible on the website is shown under depends on the plan of your choice.  There may be time delay between the time you post an advert/listing the time the advert/listing is visible on the website.

9. Fees

Using the website is free. However fees are charged for certain premium services. The fees are specified on website.  The basis of these fees is stated on the website. Fees are inclusive of VAT, where applicable. Fees are in South African Rand (ZAR) and may change from time to time without prior notice. All fees are non-refundable.

10. Coupons

Any coupons that black24 might issue in connection with the website expire within 30 days of issue. Coupons are not redeemable for cash or any other consideration and are non-transferable. If your Account is terminated any unexpired will automatically terminate. You will no longer be able use these coupons.

11. Our rights to use your content

By submitting or posting any content to black24, you grant black24 an irrevocable right and licence to use your content, distribute, adapt, modify, reproduce, edit or publish it or  use you content to create other content of any form and at our discretion.   You further grant black24 a right to sub-licence your content.

13. Warranties

We offer no warranties of any kind for any content or information on the website and shall not be deemed to have made any implied warranties or representations relating to website. The website and all content are made available to you ‘as is’. black24may not monitor or vet users or content of the website. As such black24 does not vouch for the accuracy or correctness of any content. Your use of the website is entirely at your own risk. If you are dissatisfied with the service offered by black24, or have suffered loss, damage or prejudiced, your sole and only remedy is to discontinue the use of the website.

14. Limitations and exclusions of liability 

Dongol is not a supplier of goods in terms of Consumer Protection Act. Any transaction between users is a private transaction between those users. Dongol simply provides the platform for users to engage with other sellers/buyers. When you purchase any item, you are not purchasing it from black24 but from other users in a private deal. black24 plays no role in facilitating payments and is not a payment intermediary in relation to transactions between users. black24 plays no role in the delivery of items purchased and does not as an intermediary in relation to the delivery of any items/service purchased. As stated above, black24 accepts no responsibilities whatsoever for any loss or damage of any kind from the use of this website. black24 does not offer any warranties of any kind for your use of this website.  You agree to use it at your entirely at your own risk. black24 makes no claims, promises or warranties about the reliability, accuracy, quality safety or security of the service. black24 makes no claims about the security of your content, your personal information, or the website content. black24 is not liable to you or any or any other party for any injury, damage, prejudice or loss that might arise, for example, from the websites inaccessibility, network issues, website malfunction, website errors, data security breaches, false reviews, scams, fake news or false adverts. black24 does not accept any liability for posting by any user of any defamatory abusive, racially insensitive, unlawful or illegal information or posting of any information which infringes upon the rights of another person. You agree not to hold black24 responsible for any losses or damages suffered from the use of the website.

In the event that we are found liable, black24’s maximum aggregate liability to you for losses or damages that you suffered in connection with the website is limited to the greater of (i) the amount paid, if any, by you to black24 for the service in the last 12 months prior to the action giving rise to liability, or (ii) R90

15. Breaches of these terms and conditions

black24 may edit, delete or reject you advert/listing where it deems necessary. black24 may change the category of your advertisements/listing at our discretion. Unlawful advertisements/listings are prohibited. black24 reserves to the right to remove or modify any content, without warning, if in its discretion, it contravenes these terms, has potential of putting the black24 in disrepute or is in bad taste.  We reserve the right suspend or deregister the user’s account at our discretion.

16. Third party websites

Links or referrals to third party websites by means of hyperlinks or otherwise are not recommendations. black24 has no control or influence over such third party websites and therefore accepts no liability for products or services of 3rd party websites.

black24 is the trademark of Dongol (Pty) Ltd.

18. Law and jurisdiction

The courts of South Africa shall have exclusive jurisdiction over all claims or disputes arising in relation to, in connection with the website and its use and these terms.
